PREAMBLE

Our websites supplement the preliminary description provided to the traveler in accordance with Article R. 211-4 of the French Tourism Code.

Pursuant to Articles L211-9 and R211-5 of the French Tourism Code, TERNELIA ENTRE LITTORAL ET MONTAGNES reserves the right, with the traveler’s agreement, to modify certain services included in the description provided to the traveler, notably: travel features, price, payment terms, the minimum number of participants required for the stay to take place, and contractual termination fees. Booking a stay and/or trip implies acceptance of these General Terms and Conditions of Sale.

No Right of Withdrawal

In accordance with Article L221-28-12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering, or leisure services which must be provided on a specific date or according to a set schedule.

1. PRICES

Our prices are published in Euros, VAT included. Prices do not include personal expenses.

These prices vary depending on the period of the stay, the number of participants, current commercial offers, payment and cancellation terms, and the type of room booked.

1.1. Price tables

Displayed in the establishments, they indicate the services included in the proposed prices. Prices are established in euros, based on hotel rates and prevailing economic conditions in France. They are inclusive of all taxes (except local tourist taxes) and include the provision of accommodation with all utilities (water, electricity, heating).

Stays booked with a special non-cancellable, non-refundable rate are neither refundable nor modifiable, and must be paid in full upon confirmation of the booking.

1.2. Special deals

Special deal offers are subject to conditions: non-cumulative, non-retroactive, limited by availability, and valid only for the destinations and periods specified. To benefit from some Special Deals listed on the website, it is mandatory to enter the promotional code for the chosen offer (e.g., SOLO) at the time of booking. Only promotional codes (one code per booking) provided at the time of reservation will be considered.

Promotions apply only to eligible services (excluding optional services with a surcharge).

1.3. Services booked

The services selected at the time of booking are due in full. Any unused service is non-refundable.

TOURIST TAXES collected on behalf of municipalities are not included in our prices. Except in specific cases, they must be paid on-site in addition.

ASSOCIATION MEMBERSHIP: Due to its associative status, TERNELIA ENTRE LITTORAL ET MONTAGNES must charge all its clients a membership fee. This fee, included in the price of the stay, represents 1% of the accommodation cost.

1.4. Security deposit

For stays under the “self-catering rental” formula: a deposit (pre-authorization) of €300 per accommodation unit will be requested upon arrival. It will be returned after the stay, minus any costs for replacement or cleaning, and/or any unpaid additional services. Lost keys will be charged to the client. The client is responsible for any broken or damaged items as well as damage to the facilities and property of the residence. Should the deposit prove insufficient, the client will be required to make up the difference.

For other stays, a deposit (pre-authorization) may also be requested. This deposit may be used in case of unpaid services on site, particularly bar consumption or damage to property.

1.5. Child rates

Child discounts and free rates apply only when children share a room with at least one person paying the adult rate. The applicable child rate depends on the child’s age at the date of arrival.

1.6. Price revision

The prices listed in the price tables were established based on the service rates in effect at that date.

In the event of variations resulting from fuel costs, levels of taxes or fees on travel services included in the contract, or exchange rates related to the contract, TERNELIA ENTRE LITTORAL ET MONTAGNES may adjust sales prices up or down, in accordance with Article R211-8 of the French Tourism Code. In the case of an increase, regardless of the amount, a clear and understandable itemized statement will be provided to the client on a durable medium no later than twenty (20) days before the start of the stay.

Any change in these economic conditions may therefore lead to a change in price. In the event of an increase in the package price of more than 8%, the client may either accept a modification of their contract and a substitute service, or cancel their contract and obtain a refund of all amounts paid without penalties, within a maximum of 14 days, pursuant to Article R211-9 of the French Tourism Code. The client will have a period of 7 days to notify ENTRE LITTORAL ET MONTAGNES in writing of their decision, after which any cancellation will be subject to the fees provided in Article IX below. Conversely, in the event of a decrease in the above-mentioned costs, the client will benefit from a proportional reduction in price.

2. PAYMENT TERMS

Depending on the type of rate chosen, clients are subject to different payment conditions:

  • Flexible Rate: 100% payment upon arrival

  • Semi-Flexible Rate: 50% payment at booking, balance 7 days before arrival

  • Non-Cancellable, Non-Refundable Rate (NANR): 100% payment at booking

TERNELIA ENTRE LITTORAL ET MONTAGNES will consider the booking cancelled by the client if full payment has not been made within the deadlines set, and reserves the right to reallocate the cancelled services without prior notice.

3. ANCV / HOLIDAY VOUCHERS

TERNELIA ENTRE LITTORAL ET MONTAGNES stays are approved for payment by French holiday vouchers (chèques vacances). Sending ANCV holiday vouchers must be done by registered mail with acknowledgment of receipt, addressed to:

TERNELIA ENTRE LITTORAL ET MONTAGNES declines all responsibility in case of ANCV holiday vouchers sent by regular (non-registered) mail.

4. TRANSFER OF CONTRACT

The client may transfer the contract concluded with TERNELIA ENTRE LITTORAL ET MONTAGNES to any person meeting all conditions applicable to the contract. To do so, the client must inform TERNELIA ENTRE LITTORAL ET MONTAGNES of their intention to transfer the contract, using any durable medium as defined in Article L211-12 or R211-7 of the French Tourism Code, which allows an acknowledgment of receipt, no later than seven (7) days before the start of the stay.

Any transfer made less than seven (7) days before the start of the stay shall not be binding on TERNELIA ENTRE LITTORAL ET MONTAGNES. TERNELIA ENTRE LITTORAL ET MONTAGNES will inform the transferor of any fees, charges, or additional costs that may arise from the transfer. The transferor and transferee will be jointly and severally liable for payment of the balance due as well as any additional fees, charges, or costs resulting from the transfer.

This service is available depending on the establishment. For reasons of hygiene and safety, it is subject to specific regulations. Access to wellness and spa facilities is by reservation, subject to availability, and within the limits of any contraindications to the practice of such services. The opening days and times communicated in commercial documents or booking confirmations are indicative. The TERNELIA ENTRE LITTORAL ET MONTAGNES team at your destination may decide—or be required—to modify them at any time.
